White House talks don't include NRA: gun group president

WASHINGTON (Reuters) - An effort led by Vice President Joe Biden to find ways to reduce gun violence after the Connecticut school massacre so far has not included talking to the National Rifle Association, the president of the gun rights group said on Friday.

NRA President David Keene said neither Biden nor his staff has contacted the organization since President Barack Obama unveiled the effort on December 19.

Keene said he was not surprised, given Biden's past support for new gun control laws. "He's not even a friendly antagonist," Keene told Reuters in an interview.

The lack of communication between the White House and the largest U.S. lobbying group for gun owners is a sign that the shooting in Newtown, Connecticut, has so far failed to change long-held stances on gun politics. In that tragedy, a young man shot his mother with her own gun before killing 20 children and six adults at the Sandy Hook Elementary School.

Biden and up to four Cabinet officers are holding a series of meetings with outside groups to discuss possible gun legislation. The first was with law enforcement officials, another with mayors.

The White House has said other meetings will take place with gun safety groups and gun owners, among others, but it has not said whether the NRA will be invited. The White House had no comment on Friday.

Asked about the organization's influence, Obama struck an optimistic note on Dec 19. "The NRA is an organization that has members who are mothers and fathers," he said. "I would expect that they've been impacted by this as well, and hopefully, they'll do some self-reflection."

Two days later, NRA executive Wayne LaPierre said at a press conference that new gun laws were not the answer, calling instead for some form of armed guards in every school.

Keene told Reuters: "I'm willing to talk to anybody. I'm willing to sit down with anybody up there." He added, though, that he would not agree to "gut" gun rights.

"I'm going to want to have a conversation about how we protect our children," he said. "That's a serious conversation. Offering sort of feel-good bills doesn't strike me as serious."

Biden's group is due to offer its recommendations in January.

A Reuters/Ipsos poll on Thursday found that support remains high for preserving specific gun ownership privileges, such as concealed-weapon permits, as well as for some restrictions, such as background checks for every purchase.

Edison International's Edison Mission Energy filed for Chapter 11 bankruptcy protection Monday. Edison Mission's financial woes reflect the obstacles coal faces in a market increasingly dominated by cheap natural gas and a shift towards renewables.

Environmental consulting firm sues federal drilling regulators over ...

An environmental consulting firm has filed suit against federal energy regulators to halt the Obama administration's new five-year plan for auctioning offshore oil and natural gas drilling leases on the outer continental shelf, the first leasing plan approved since the 2010 Gulf oil spill.

The lawsuit, filed Monday in U.S. Circuit Court of Appeals for the District of Columbia by the Center for Sustainable Economy, maintains that the Bureau of Ocean Energy Management used a flawed analysis to rush ahead with the leasing program in violation of several federal environmental laws.

John Talberth, the president and senior economist at the non-profit public interest consulting firm, said in a statement that the the untapped reserves "should only be developed when and if it makes compelling economic sense to do so," and accused the Obama administration of "rushing headlong into a program that will put our shores and oceans at risk and do nothing at all for America's energy security."

The five-year leasing program includes 15 scheduled sales in offshore areas in the Western and Central Gulf of Mexico, as well as portions of the Eastern Gulf, as well as the Chukchi Sea, Beaufort Sea and Cook Inlet, offshore of Alaska. Regulators estimate the program has the potential to produce 5.75 to 14.3 billion barrels of oil equivalent.

A spokesman for the Interior Department, which oversees the Bureau of Ocean Energy Management, said Monday that the department does not comment on pending litigation.

The suit contends that regulators did not consider "economic, cultural, social, subsistence, and environmental values of the renewable and nonrenewable resources" located in areas that would be affected by the proposed drilling, as well as the "potential impacts of oil and gas leasing and development activities."

Last month, more than 20 million acres off the coast of Texas were offered in the first lease sale scheduled as part of the program. It garnered about $133.8 million from 13 companies that submitted high bids for 116 offshore drilling tracts

In March, federal regulators plan to auction another 38 million acres in the Central Gulf, which will include about 7,250 federally-owned drilling tracts in water depths of nine to more than 11,115 feet.

Fight to Know: California Voters Turn Down Label Requirements for Genetically Modified Products

Many healthy food advocates were disheartened on Election Day when Californians rejected Proposition 37, which would have required the labeling of genetically modified (GM) foods across the state. GM foods have had genes from other plants or animals inserted into their genetic code to optimize for one or another trait, such as resistance to pests, better taste or longer shelf life, and are controversial because scientists don?t know the ramifications of mixing genetic codes on such a widespread scale.

While it was close, those against the so-called ?California Right to Know Genetically Engineered Food Act? prevailed, with 53.1 percent of the vote. The proposition called on food manufacturers to label foods containing GM ingredients on the front or back of the packaging with the phrase ?partially produced with genetic engineering??and not to label or advertise such foods as ?natural.? Proponents developed the proposition in lieu of federal action requiring labeling of GM foods?as exists in 50 other countries.

Proponents of the bill raised some $9 million and garnered some 46.9 percent of the vote, indicating that upwards of four million Californians fear the potential effects of GM foods and are in favor of greater transparency on the part of the food industry. But such efforts weren?t enough to overcome aggressive marketing by so-called Big Food companies including Monsanto, Coca-Cola, ConAgra, Nestle and Kraft, who poured some $45 million into the ?No on 37? campaign.

Backers of the proposition are crying foul. Public health lawyer Michele Simon reports that some of the companies involved in defeating the bill engaged in lying, scare tactics, misrepresentation and various dirty tricks ?to protect their profits and keep California voters uninformed about their food choices.?

?The No campaign listed four organizations in the official state document mailed to voters as concluding that ?biotech foods are safe?,? she says. ?One of them, the American Council on Science and Health, is a notorious industry front group that only sounds legit. Another, the Academy of Nutrition and Dietetics, actually has no position and complained about being listed?? The other two groups, the National Academy of Sciences and the World Health Organization, have more nuanced positions...than just ?safe.?

Simon also criticizes Big Food for its claims about high food costs, ?shakedown lawsuits? and ?special interest exemptions? if the law passed: ?While each of these claims is easily debunked, being outspent on ad dollars makes it hard to compete, especially when all you can really say is, ?that?s not true?.?

The battle over GM labeling in California may be over for now, but the war rages on nationally. Just Label It, a nonprofit started by Stonyfield Farm magnate Gary Hirshberg, is trying to persuade the U.S. Food and Drug Administration (FDA) to require GM food labeling nationally. Readers can help by signing the campaign?s online petition. Beyond that, Just Label It recommends eating more fresh vegetables and unprocessed foods (the vast majority of processed foods in the U.S. contain either GM corn or soy) and looking for the USDA Organic label, which precludes any foods containing GM ingredients.

Phones to be pocket seismometers

The smartphones in our pockets are about to get even smarter.

Scientists want these ubiquitous gadgets to be put to work helping them detect and investigate earthquakes.

The devices contain accelerometers and a team at the Berkeley Seismic Laboratory says the mechanisms are capable of monitoring tremors.

An app is being developed that will record the shaking during major events and then report the data back to a central server over the cell network.

The high numbers of smartphones now in circulation mean researchers could get very detailed information on who felt what, and where.

It is the sort of insight that is useful for future hazard assessment and risk planning, but real-time data could also eventually play an important role in California's earthquake early warning system.

This aims to give people precious seconds' advance notice that a big trembler is on its way.

"Nowadays, smartphones carry all sorts of sensors, and we can put these to use in unexpected ways," explained Qingkai Kong. "Right now, we can only detect earthquakes above about Magnitude 5.0, but with better accelerometers in future smartphones we would hope to detect smaller ones as well," he told BBC News.

The University of California, Berkeley, researcher was speaking here at the American Geophysical Union (AGU) Fall Meeting, the world's largest annual gathering of Earth scientists.

He and colleagues were not sure at first that mobile phones would be up to the task of being pocket seismometers. So a selection of the gadgets was put on the lab's "shake table".

This instrument can simulate various grades of tremors. It is usually employed to test the robustness of various construction techniques, to provide confidence that buildings will not collapse during an earthquake.

The results clearly demonstrated that the accelerometers - used primarily in phones as part of the mechanism to tilt the screen - could pick up the shaking.

The confounding issue, of course, is that phones are rarely left alone on a flat surface - they are moving around with their owners.

But the team believes it can solve this problem as well, and has developed an algorithm that will subtract the human "noise" in the data.

"The pattern recognition algorithm sees typical human activities such as walking, running and driving, and we use that information to disengage those activities from the earthquake signal," said Mr Kong.

This algorithm is rarely fooled, he added.

Berkeley's project is very much in its early stages and the team hopes soon to start recruiting more people into its research project. It is likely to issue a test app to thousands of volunteers across the San Francisco Bay Area next year.

This is a region that lives with the knowledge that a major quake could happen at any time. A Magnitude 7.9 event in 1906 flattened San Francisco; and Berkeley itself sits right on top of the Hayward Fault, which many scientists suspect will deliver the next big blow to the Bay Area.

Having good reports on the amount of shaking in an earthquake from different locations is invaluable data.

The level of disturbance a person feels will depend on many things: the number and quality of buildings close by, and the nature of the soils on which they are built, etc. It is even possible for individuals on opposite sides of a street to have quite different experiences.

Shaking reports help planners identify weaknesses in construction standards and are used to raise the level of preparedness for the next big event.

Moreover, a smartphone seismic network has potential to feed directly into the early warning system.

This relies on being able to detect the faster-moving but not-so-damaging P-waves of a seismic event ahead of its S-waves, which cause most destruction.

How much warning an individual gets will depend on how far they are from the epicentre of a quake.

It can though amount to several seconds - time enough for individuals to take cover in a doorway, for trains to slow, for planes to be passed a message to abort their landing, and for surgeons to finish a delicate procedure.

The current generation of smartphones does not have the sensitivities yet to participate in such a programme, but the performance being promised by tech companies for future accelerometers suggests the dream may soon be fulfilled.

Being everywhere and always on, smartphones would then not only provide a dense source of data for the warning system but be the means also to issue its alerts through dedicated tones and messages.

4 Dead, Including 2 Children, In Northern California Car Crash

SACRAMENTO, Calif. ? Two children were among four people killed when a car collided with a minivan on a rural Northern California highway, authorities said.

The wreck came as a Toyota Prius crossed the center line on Highway 50 near Placerville on Saturday night and struck a Toyota Sienna minivan "broadside," said California Highway Patrol spokesman Officer John Frizzell. The crash also left five people injured.

Three people in the Prius ? a 39-year-old man driving the car, a woman and a child ? were killed in the crash, Frizzell said. Another child in the car suffered moderate injuries. Three of the victims who died lived in the San Francisco Bay area. They were pronounced dead at the scene.

Of the five people in the minivan, a 4-year-old girl was killed, Frizzell said. She died after being taken to a hospital. The four others ? the 35-year-old female driver, a 51-year-old man and two 1-year-olds suffered minor to moderate injuries. By late Sunday afternoon no names had been released.

Weather conditions at the time of the crash were clear.

"We don't know what caused the Prius to cross into oncoming traffic," Frizzell said Sunday. "There's an infinite number of possibilities."

Investigators have pulled computers from both vehicles that would indicate how fast they were going at the time of the crash, but collecting that information would probably take days, Frizzell said.

The highway where the crash took place is just outside of Placerville, about 45 miles east of Sacramento. The highway has two lanes, with minor to moderate curves, and with a speed limit of 65 miles per hour, Frizzell said.

Four Major Variables that Determine Market Price

Over the last two days we looked at the four main variables that determine home price:

  1. borrower income,
  2. allowable debt-to-income ratios,
  3. interest rates, and
  4. down payment requirements.

Today we are looking at some of the minor cost inputs that work by influencing the major ones; property taxes and Mello Roos taxes, HOAs, and insurance.

PITI

lenders have an acronym called PITI, which stands for principal, interest, taxes, and insurance.To that we can add HOA dues and other known costs. When people qualify for a loan, the difference between what their income can support and the payment they can make to the lender is a number of related expenses that only homeowners must pay; property taxes, special assessments and Mello Roos, insurance and homeowners associations. These expenses (1) reduce your payment to the lender, (2) reduce the amount you can borrow and bid, and thereby (3) reduce the value of real estate.

Property Taxes

Property taxes have long been a source of local government tax revenues. Real property cannot be moved out of a government?s jurisdiction, and values can be estimated by an appraisal, so it is a convenient item to tax. In most states, local governments add up the cost of running the government and divide by the total property value in the jurisdiction to establish a millage tax rate. California is forced to do things differently by Proposition 13 which effectively limits the appraised value and total tax revenue from real property. Local governments are forced to find revenue from other sources.

Proposition 13 limits the tax rate to 1% of purchase price with a small inflation multiplier allowing yearly increases. In California, the first half of regular secured property tax bills are due November 1st, and delinquent after December 10th; the second half are due February 1st, and delinquent after April 10th each year. If the delinquent date falls on a Saturday, Sunday, or government holiday, then the due date is the following business day.

Often the lender will compel the borrower to include extra money in the monthly payment to cover property taxes, homeowners insurance, and private mortgage insurance, and these bills will be paid by the lender when they come due. If these payments are not escrowed by the lender, then the borrower will need to make these payments. I am a fan of impound accounts because the tiny amount of extra interest you may make saving in your own account is not worth the hassle.

Due to Proposition 13, the property tax bill is very easy to calculate; take one percent of the purchase price. Divide it by twelve to get the monthly cost.

Automatic re-assessment for cash-out refinancing

An idea emerged from the aftermath of the housing bubble; limit HELOC abuse by making cash-out refinancing in excess of the original purchase price an event that triggers property tax re-assessment. The effect is to drive up the cost of borrower money and discourage the behavior. It would probably be very effective.

The lenders would cry foul, and in particular there may need to be an exception for reverse mortgages to accommodate seniors (I think reverse mortgages are a bad idea, but forcing retired people to leave their homes is probably worse). Despite the resistance, the legislation if passed would curtail HELOC abuse, but in an economy dependent upon Ponzi Scheme financing, such legislation is unlikely; although, if the budget shortfall gets bad enough, everything will be on the table. Municipalities would love the idea because their revenues would grow as long as there are Ponzis.

Mello Roos Taxes

In our reports, we classify these as other taxes and assessments because Mello Roos fees are paid through your tax bill. To understand how this became a tax you pay, a brief overview of the Community Facilities District Act is in order (What is Mello Roos?.pdf). From Wikipedia:

A Mello-Roos District is an area where a special property tax on real estate, in addition to the normal property tax, is imposed on those real property owners within a Community Facilities District. These districts seek public financing through the sale of bonds for the purpose of financing public improvements and services. These services may include streets, water, sewage and drainage, electricity, infrastructure, schools, parks and police protection to newly developing areas. The tax paid is used to make the payments of principal and interest on the bonds.

Mello-Roos is deductible in some cases but not in others.

That is the textbook version, now I will give you mine. Imagine you are a real estate developer, and you have a parcel of land that would be worth $10,000,000 if it had infrastructure installed; unfortunately, you do not have the money to install this infrastructure and wait for the investment to come back to you in land or home sales.

What if you could take out a 30-year mortgage on your infrastructure improvements and borrow the money? Now you can finance the deal and develop the land, but there is still a problem. How do you get the homeowner to pay off the infrastructure mortgage after they buy the house?

The solution elected officials came up with was to create a special tax district so the repayment of the bonds to fund the infrastructure is bumped up the payment priority list. In short, you can?t avoid paying Mello Roos, or the tax man will be after you, and he has the power of foreclosure, though it is seldom used.

For those of you that are homeowners, the next time you write that check for Mello Roos, realize that you are paying down the loan for the infrastructure around you. You didn?t think the developer absorbed those costs, did you? That would cut into profits.

Realistically, Community Facilities Districts do encourage private development by making marginal projects feasible. It keeps development in the hands of private individuals rather than municipalities developing their own roads, streets and utility systems. To the degree you believe these results are desirable, you should support Mello Roos.

Without the ability to develop marginal projects, supply is always lagging behind. The Community Facilities District Act does encourage development to lead into growing markets and blunt the impact of supply shortages. Despite the additional supply this law puts on the market, it has failed to prevent housing bubbles.

Determining Mello Roos

Property taxes and Mello Roos fees are deducted from a borrower?s available income to service cashflow, and thereby it reduces the amount they can finance. In essence, there is already a 30-year mortgage on the property you must pay off ? your portion of the Mello Roos ? so the purchaser money mortgage must be paid with left-over funds.

Builders and developers both know the impact of Mello Roos, so builders will pay less for lots with high Mello Roos fees because they know they will have to discount the purchase price of the final product in order to qualify any buyers. Developers want the Mello Roos fees to be as high as possible because the higher the fees, the greater the bond revenue developers receive. Builders want the Mello Roos to be as low as possible to give them competitive advantage. The resulting compromise usually puts Mello Roos at between 0.5% and 0.8% of total value.

The good news with Mello Roos is that the fees are fixed. As house prices go up, the Mello Roos fees become less burdensome to later buyers. If the Mello Roos are set at 0.8% of an initial $200,000 sales price, the same figure represents only 0.4% of a $400,000 resale price. Of course, the reverse is also true.

When the Irvine Company first opened Woodbury and Portola Springs, they were priced to the peak and they had maximum Mello Roos. Now that houses are selling for lower price points, the Mello Roos start to become onerous. If the original sale price of a condo was $400,000, and the Mello Roos were 0.8% of value, if the condo resells for $200,000, the Mello Roos now represent 1.6% of the purchase price. That is a stiff property tax bill by California standards.

Homeowners Insurance

Homeowners insurance protects the property owner against loss. It?s nearly always required by lenders because they want to protect the value of their collateral if they should need to foreclose on the property. Even if a lender doesn?t require it, the risk of catastrophic loss makes such insurance a necessity even for those who pay cash. Who would want to lose half a million dollars or more in a fire?

A standard policy insures the structure and documented personal property within. In addition, the package policy covers liability and legal responsibility for property damage caused outside the home itself by the owners, the members of the owner?s family, and even the family pets. Disaster damage is included, but this carries some exceptions, most notable here in California is earthquake damage, but damage due to floods and poor maintenance are also excluded. Seperate policies can be purchased to cover earthquake and flood damage, but these policies can be quite costly.

Homeowner Association Dues and Fees

Many modern planned communities have homeowners associations formed to maintain privately owned facilities held for the exclusive use of community residents. These HOAs bill the owners monthly to provide these services. They have foreclosure powers if the bills are not paid. It is given the authority to enforce the covenants, conditions, and restrictions (CC&Rs) and to manage the common amenities of the development. It allows the developer to legally exit responsibility of the community typically by transferring ownership of the association to the homeowners after selling off a predetermined number of lots. Most homeowners? associations are non-profit corporations, and are subject to state statutes that govern non-profit corporations and homeowners? associations.

California has many problems with condo associations that are poorly managed. These associations often underfund their reserves creating potential for costly assessments. This information can be difficult to find and analyze prior to a purchase. HOAs only provide their financials to potential buyers who are already in escrow, and these documents often appear at the last minute preventing any meaningful analysis. This week?s Monday night game features two similar teams with dominating defenses and powerful rushing attacks as the Chicago Bears travel to Candlestick Park to face off against the San Francisco 49ers.

San Francisco is ranked third in total defense in the league while Chicago is not far behind with the fifth overall defense. Along with similar defenses, both teams are ranked in the top 10 in rushing yards and in the bottom five in passing yards.

The 49ers will have to find a way to stop the powerful run combination of Matt Forte and Michael Bush while the Bears will be forced to challenge Frank Gore from getting up field.

Chicago will have a difficult time throwing the ball against the pass rush of San Francisco especially with starting quarterback Jay Cutler out with a concussion. Jason Campbell will be the starter for the Bears in his place.

San Francisco should have the advantage in the passing game with their starter Alex Smith in the game as long as the offensive line gives him enough time and if Smith keys off the secondary of the Bears.

The Bears have totaled 19 interceptions this season and will be looking to add to that total against Smith who has struggled at times this season.

Two teams that match up so evenly against each other will have to play smart football if they want to come away with a victory. The winner of this game will come down to fundamentals.

The little mistakes will cost a team the game when up against an opponent that is so similar to them which is what both Chicago and San Francisco will have to deal with this week.

If the 49ers want to win this game they will have to commit fewer penalties throughout the night and win the turnover margin. If they can do that, San Francisco should be able to step off the field Monday night with a win.

Legacy funds might go to Fond du Lac Chippewa band after all ...

A dispute over whether Minnesota Legacy Amendment tax dollars should be used to help an Indian band buy land on its reservation might be easing.

With an apparent reversal of opinion by at least one member of the Lessard-Sams Outdoor Heritage Council, the Fond du Lac Band of Lake Superior Chippewa edged closer to being recommended to get $1.7 million in Legacy funds to protect a 440-acre parcel of land near the St. Louis River in northeastern Minnesota -- if the money becomes available.

The change of stance by state Rep. Denny McNamara, R-Hastings, follows a recent meeting among council Chairman David Hartwell, band Chairwoman Karen Diver, a band attorney and two staff members of the band's Resource Management division.

In a 7-5 vote Sept. 21, the council denied the band's request for the money to buy the land, which includes an 80-acre lake and 83 acres of wetlands. McNamara was the main voice of opposition in discussion leading up to the vote.

The affirmative rejection of the project -- an uncommon move by the council -- prompted Diver to object in writing. In a letter, she accused the council of failing to follow its own criteria for recommending projects, alleged the result was "punitive and discriminatory" and suggested a "constructive path forward." She said the denial was because of treaty rights band members have that have been upheld by courts.

During the Sept. 21 meeting, McNamara specifically objected to those treaty rights -- which allow band

members to hunt and fish under a separate set of rules than nonmembers -- being in effect on the parcel. He said it would set a "precedent" for Legacy dollars.

A staff member corrected him during the meeting: The 1854 treaty rights extend over a wide swath of the Arrowhead and are in effect for other lands that have been bought with Legacy tax proceeds. The band previously had agreed in writing that even though it would own the land, it would agree to all other terms that go with every other Legacy project, including public access for everyone. The Fond du Lac reservation's borders are not closed. The parcel is privately owned and being marketed for private development.

In an interview Wednesday, Oct. 17, McNamara maintained he wasn't aware the project wasn't precedent-setting when he voted against it. "I didn't understand that we had already been buying within the ceded territory," he said. "I was understanding that was going down new territory, and that's not the case. That changes it."

McNamara said he expects that the Legacy Amendment sales tax, approved by voters in 2008, will raise more money this year than the $92 million previously forecast. He said he would support putting that money toward the Fond du Lac project.

"I like the project," he said. "We'll see how the next forecast is."

Hartwell described his meeting with Diver as "constructive" and cordial.

"There was no direct talk of litigation," he said. "They could have taken a much harsher approach. I think they really want to see themselves as potential full partners over time."

In an interview Thursday, Diver said it's premature to speculate about whether the project might now get funded, but she said she was encouraged by the meeting with Hartwell.

"We're hopeful the board will take the time to address any misconceptions they may have," Diver said.

What was new about the Fond du Lac's request was that it was the first time a sovereign nation had requested Legacy money to buy land within its reservation. That was explained to McNamara shortly before members voted Sept. 21.

When asked about that in the recent interview, McNamara said: "What's the difference? It's going to be open to the public. If that was the reason we were doing it, then it would be wrong. We can't tell one group -- Becker County or Dakota County -- one thing, and then another group another thing."

HBT: D-backs, A's, Marlins pull off 3-way deal

Here?s doozy of a trade to break up an otherwise quiet day around major league baseball.

Per announcements from the clubs involved, the Diamondbacks, Athletics and Marlins have pulled off a three-way trade which will send Heath Bell to Arizona and Chris Young to Oakland.

Here are the specifics as we have them right now:

The Diamondbacks dealt outfielder Chris Young and cash considerations to the Athletics for infielder Cliff Pennington and prospect infielder Yordy Cabrera. The Diamondbacks then sent Cabrera to the Marlins in exchange for reliever Heath Bell to complete the three-team deal.

Clark Spencer of the Miami Herald reports that the Diamondbacks will cover $13 million of the $21 million remaining on Bell?s contract. It?s clear that something had to be done with the disgruntled reliever after his disastrous first season in Miami, where he clashed with manager Ozzie Guillen and even some teammates. With that in mind, the Marlins have to be thrilled that they were able to not only get rid of Bell, but somehow convince the Diamondbacks to cover the majority of his remaining salary.

We knew the Diamondbacks would likely deal at least one of their outfielders this winter, but it?s hard to believe Kevin Towers couldn?t do better than this as a return for Young, especially considering the money they will now owe to a declining reliever. And in a poor environment for a bounceback, to boot. Towers must really like Pennington, but it?s hard to understand the rush. The Diamondbacks picked up the option on J.J. Putz?s contract for 2013 this morning, so Bell will be asked to pitch in a set-up role with his new club.

This looks like an excellent deal for the Athletics, even though Young is a bit of a curious fit with Yoenis Cespedes and Josh Reddick set in the corner outfield spots and Coco Crisp under contract for $7 million for next season. Still, hard to pass up a deal for a talented center fielder at this price. They likely got a bit of a discount because of Young?s shoulder injury from this season.

Young, 29, is owed $8.5 million in 2013 while his contract includes an $11 million club option for 2014 or a $1.5 million buyout. Per Steve Gilbert of MLB.com, the Diamondbacks are sending $500,000 to Oakland as part of the deal.

Given the surplus of outfield talent with the A?s, it wouldn?t be surprising if we see some more wheeling and dealing from Billy Beane soon, possibly with a deal involving Crisp or Seth Smith. It?s also worth noting that by dealing Pennington to the Diamondbacks, the A?s are more likely to exercise their portion of the $10 million player option Stephen Drew?s contract for next season.

Cabrera was ranked as the No. 15 prospect in the Athletics? organization by Baseball America coming into this season, but his numbers have been pretty underwhelming as a pro. The 22-year-old has a .230/.297/.351 batting line and a .648 OPS over three seasons and has yet to play above High-A. This was mostly about the Marlins getting out from under Bell?s contract. And they certainly accomplished that goal.

FRUITA, Colo.- People were taking part in "Paws and Pies" Saturday at the Hot Tomato in Fruita.

The Roice-Hurst Humane Society held its second annual adoption and fundraiser event right outside the restaurant.

All the proceeds from the restaurant's sales will benefit the nonprofit shelter.

Seven dogs were up for adoption.

"When people come out and support us and play with our pets and help socialize with them, it's just a wonderful day," said Elaine Johnson-Craig, fundraising coordinator for the Roice-Hurst Humane Society.

Creature Comforts Animal Hospital also offered microchipping costing no more than $35.

National Geographic to auction famous photos, art

NEW YORK (AP) ? National Geographic Society has chronicled scientific expeditions, explorations, archaeology, wildlife and world cultures for more than 100 years, amassing a collection of 11.5 million photos and original illustrations.

A small selection of that massive archive ? 240 pieces spanning from the late 1800s to the present ? will be sold at Christie's in December at an auction expected to bring about $3 million, the first time any of the institution's collection has been sold.

Among the items are some of National Geographic's most indelible photographs, including that of an Afghan girl during the Soviet invasion of Afghanistan, a portrait of Admiral Robert Peary at his 1908 expedition to the North Pole, a roaring lion in South Africa and the face of a Papua New Guinea aborigine.

Paintings and illustrations include N.C. Wyeth's historical scene of sword-fighting pirates, Charles Bittinger's view of Earth as seen from the moon, and Charles Knight's depictions of dinosaurs and other prehistoric animals.

They are being auctioned "to celebrate our legacy .... and to give people a chance to buy a little part of this great institution's history," said Maura Mulvihill, senior vice president of National Geographic's image and video archives.

"We think of ourselves as the unsung fathers of modern photojournalism," she added. "I don't think people are aware of what a massive instructive archive this is."

Proceeds from the Dec. 6 auction, just weeks before National Geographic's 125th anniversary, will go for the promotion and preservation of the archive and "the nurturing of young photographers, artists and explorers ... who are the future of the organization," Mulvihill said.

National Geographic sponsors and funds scientific research and exploration through its official journal, National Geographic Magazine, which reaches 8.8 million people worldwide in 36 countries and in 27 languages. The society reaches millions more through its National Geographic Channel, books and other sources.

While National Geographic is known today for its photography, early magazines were filled with artwork.

Among the fine art being offered is an oil painting by Tom Lovell of Gen. Robert E. Lee's Civil War surrender at Appomattox. It's expected to fetch $20,000 to $30,000.

"The Duel On The Beach," a painting of two pirates by the American artist N.C. Wyeth, is estimated to sell for $800,000 to $1.2 million. Another Wyeth, "James Wolfe at Quebec," was commissioned to accompany a 1949 article on the general taking Quebec from the French general the Marquis de Montcalm. It has a pre-sale estimate of $30,000 to $50,000.

Steve McCurry's photograph of the Afghan girl carries an $8,000 to $12,000 pre-sale estimate. McCurry has made a special print of the image for the sale, and part of the proceeds from it will be donated to the Afghan Girls' Fund.

There's also Edward Curtis' 40-volume photo portfolio and book, "The North American Indian," believed to have been owned by Alexander Graham Bell. It's estimated at $700,000 to $900,000.

The sale also contains some images that have never been published, including a selection from Herbert Ponting, who produced some of the most enduring images of the Antarctic.

Going underground: India needs to dig deep to keep lights on

DHANBAD, India (Reuters) - The slick mechanized operations at the Piparwar open-cast mine in eastern India, an ugly gash in the landscape bigger than New York's Central Park, could lead the casual observer to conclude that the country's coal industry is on a roll.

Piparwar, run by the state miner, produces some of the lowest-cost coal in India, just what's needed for a country struggling to get enough of the "black diamond" to fix a power crisis that recently plunged half a billion people into darkness and chokes economic growth.

With oil and gas output disappointing and hydropower at full throttle, Asia's third-largest economy still relies on coal for most of its vast energy needs. About 75 percent of India's coal demand is met by domestic production and, according to government plans, that won't change over the next five years.

The hitch is that India is running out of cheap open-cast coal from existing mines like Piparwar. Unless it starts investing now in underground mines, within a decade it will face a huge leap in energy import costs that could derail industrial projects, crimp economic growth and drive up inflation.

"With the ballooning demand for coal in India, open-cast mining has become the easy option, albeit at a great cost to the environment and society," said a senior executive at a power company, speaking on condition of anonymity.

"This easy option is likely to be exhausted within the next 10-12 years when the shallow seams amenable to open-cast mining dwindle."

WRONG DIRECTION

Coal India Limited, the state-run miner that produces 80 percent of the country's coal, recognizes the need to raise the amount that underground mining contributes to total output from just one tonne out of every 10.

But the higher costs and lower output of deep mining - Coal India's chairman has said its existing underground mines are loss-making - are pushing it in the wrong direction.

Its plans for new mines target a contribution from underground of only about 7 percent.

That would be disastrous, argues D.C. Panigrahi, director of the Indian School of Mines in Dhanbad, a mining town in the heart of Jharkhand, the country's most productive coal state.

He says that unless Coal India cuts its dependence on open cast mining by around 5 percentage points per year, overall output will start to stagnate around the end of this decade.

If India is going to meet its output targets of 750 million tonnes by 2016/17 - a rise of nearly 40 percent from the current financial year - it needs to act soon. It takes on average six years from planning to production for an underground mine.

India used to mine most of its coal underground, just as the world's biggest producer, China, currently does for its huge output of more than 3.5 billion tonnes a year. But it was not getting enough out of the ground fast enough to meet demand.

"When everything was underground, the growth rate was less than 2 percent per annum. We needed more than 5-6 percent growth and that could only come from open cast," said Partha Bhattacharyya, a former chairman and managing director of Coal India.

Open-cast mining strips away topsoil, or "overburden", to expose the seams underneath. It is much more economical than underground mining, where up to 70 percent of the coal must be left to act as support for the tunnels and galleries.

But while India has ample coal reserves - at about 286 billion tonnes, they are the world's fifth-largest, according to BP - not all of that is accessible by simply removing topsoil.

LAND PROTESTS

The other problem with open cast is the need to buy vast tracts of land, far more than underground mines, whose shafts, winding gear and offices can be set up on as little as 2.5 acres (1 hectare).

"Getting the land is becoming more and more difficult in a democratic country like India," said Panigrahi.

Protests highlighting land rights and acquisition issues have stalled industrial projects across India, including the country's biggest foreign investment - a $12 billion steel plant in the eastern state of Odisha planned by South Korea's POSCO that has been on the drawing board since 2005.

In Dhadu village, about 75 miles from Jharkhand state's capital, Ranchi, Electrosteel Castings Ltd has managed to buy just 435 acres of about 2,800 acres it needs to set up an open-cast mine and steel plant.

It now faces further uncertainty, with the government threatening to take back the concession amid the fallout from a wider corruption scandal over the awarding of coal blocks.

"We've given away our land happily to the company. But now, it has been four years. Nothing has come up and we are getting old. Our youngsters are unemployed," said 70-year old Asim Mia, who along with his two brothers gave up 1.5 acres of land each for the North Dhadu coal block.

Jharkhand is one of India's poorest states, despite its rich natural resources, and locals worry that unrest and unemployment plays into the hands of Maoist 'Naxalite' activists, whose attacks on coal facilities and railroads have heightened tension in the area over land rights.

The government is planning a revamp of the country's colonial-era land acquisition laws that India Inc. worries could force it to pay four times the market price for land in rural areas. That could hit the cost of mining projects and slow the pace of fresh production coming online.

"SNAKES AND LADDERS"

About half an hour's drive from Ranchi, the criss-cross of railway lines and electricity pylons that map the state's rapid industrialisation gives way to protected forest land and the bright green shoots of this year's rice crop.

Some 30 percent of Jharkhand's land is designated forest, among the highest in India, posing yet another difficulty for companies in search of land for open-cast mines.

For every acre of forest purchased for industrial plans an acre of undeveloped land elsewhere, plus money for afforestation, need to be handed to the forest department, just one part of the complex process of securing state and federal clearance to develop forest land that one state government official described as "a game of snakes and ladders".

The average cost of open-cast coal for Coal India is about $13 a tonne, former CIL chairman Bhattacharyya says. For underground mines, the average cost is about $75 per tonne, according to analysts Wood Mackenzie, which makes many of them loss-making at current contract and market prices.

"Everything comes down to economics," said Wood Mackenzie's coal market analyst, Prakash Sharma.

"Companies try to look at the open-cast method first but when land acquisition becomes difficult, there's a compromise on mining costs and you opt for underground mining."

The economics will push India's power bill higher, and with it inflation: it is just a question of how much and when.

Already, surging demand for electricity generation means that Coal India's open auction prices are more than double those of its long-term deals and it has delayed sealing those commitments at lower prices.

Expensive imports partly fill the gap in demand and their contribution is set to grow, but buying from abroad currently costs up to 50 percent more.

In the most optimistic scenario envisaged by the government's Planning Commission, imports could be 182 million tonnes in 2016/17 from about 90 million tonnes in 2011/12.

Even under this best-case, Coal India would probably struggle to supply more than half of the extra demand created by new power generation capacity the government says is needed.

The power company executive believes time is running out.

"A severe power crisis is imminent if we do not shift our focus to underground coal mining," he said.

"Trekkies" break world record at London convention

LONDON (Reuters) - Star Trek fans made history on Saturday by breaking the record for the largest gathering of people dressed as characters from the TV series at the "Destination Star Trek London" convention.

An estimated 1,083 costume-clad "trekkies" assembled at the event at London's ExCel centre, narrowly beating the previous record of 1,040 characters, which was set at the bigger, annual Star Trek convention in Las Vegas in August.

The achievement will be officially verified by Guinness World Records within a few days, but organisers were confident they had topped the Las Vegas record.

The majority of record-breakers dressed in the colour-blocked uniforms of the Starfleet, with Vulcans, Klingons and Romulans peppering the crowd.

Trekkie Mark Whitfield went to extreme lengths to participate, wearing a full-body suit to emulate a mugato, a beast from "Star Trek: the Original Series".

"It looks silly, it's just a gorilla suit painted white with horns on it. It's very, very hot. In fact, I was on the verge of collapse when a very kind person gave me a bottle of water because I dehydrated quite badly," he said.

"Destination Star Trek London" is the first live Star Trek event in Britain for over a decade. Around 17,000 fans came to London to celebrate the 46-year-old TV and film franchise, which has spawned six television series and 11 feature films.

"NERDS"

Dawn Harris, 26, who had created an Orion slave girl costume and painted herself metallic green, said there was great enthusiasm for the world record attempt.

"There just hasn't been a convention in the UK for so long. So I think everyone wants to be involved in everything as much as they can. Everybody saw that guy jump out of a plane in space so people are drawn to things like that," she said, referring to Felix Baumgartner's record-breaking jump from a balloon near the edge of space last Sunday.

"Nerds like achieving missions. We've been set a quest and it must be achieved," Harris's fianc?, Ryan Croft, added.

Outlandish costumes were ubiquitous at the event, which saw Britain's first Klingon wedding on Friday. Swedish couple Jossie Sockertopp and Sonnie Gustavsson tied the knot in full Klingon attire and exchanged vows in the fictional and guttural-sounding language of the Star Trek characters.

The three-day convention also saw all five captains from the TV series appear on stage together for the first time.

The captains played by actors William Shatner (Captain Kirk), Patrick Stewart (Captain Picard), Avery Brooks (Captain Sisko), Kate Mulgrew (Captain Janeway) and Scott Bakula (Captain Archer) joined forces to officially open the convention on Friday night.

Speaking ahead of the opening ceremony, 81-year-old Shatner appeared moved when discussing the show's loyal and sometimes obsessive fans in an interview with Reuters.

"It's an accumulation of a lot of work and a lot of people travelling from all over the world here. It's sort of monumental in its worth," Shatner said.

The veteran actor turned filmmaker has released the documentary "Get a Life!", which examines why fans attend conventions.

"The conclusion that I come to is that it's (Star Trek) mythological," Shatner told Reuters. "It's a desire for mythology that we don't have in this age."
